By using rushcigars.com or placing an order, you agree to these terms and to our Privacy Policy, Shipping Policy and Returns & Refunds Policy. If you do not agree, please do not use the site.

Eligibility

You must be at least 21 years old, or the minimum legal age to purchase tobacco in your jurisdiction, whichever is higher, and legally able to enter into a contract. Full detail is on our Age Verification page.

Products, descriptions and pricing

We work to describe our products accurately, but cigars are a natural, handmade product: wrapper shade, veining and construction vary from cigar to cigar, and photographs are representative rather than exact.

Prices are in Canadian dollars and exclude taxes unless stated otherwise. We may change prices, and correct pricing or description errors, at any time before an order is accepted. Where an obvious error is found after you have ordered, we will contact you and either honour the corrected price with your agreement or cancel and refund the order.

Orders and acceptance

Your order is an offer to buy. A confirmation email acknowledges that we have received it, not that we have accepted it. The contract forms when we ship the goods.

We may refuse or cancel any order, including for suspected fraud, a failed age check, a shipping restriction at your address, a pricing error, or stock that is unavailable. Cancelled orders are refunded in full.

Stock and availability

Stock levels shown on the site are indicative. Some brands and sizes are produced in limited runs and can sell out or be discontinued by the manufacturer without notice. If we cannot fulfil part of your order we will contact you and refund the affected items.

Your account

You are responsible for keeping your account credentials confidential and for everything done under your account. Tell us promptly if you believe your account has been used without your permission.

Acceptable use

You agree not to use this site to break the law, to buy tobacco for anyone under the legal age, to resell our products without our written agreement, to scrape or copy the site systematically, or to interfere with its operation or security.

Intellectual property

The layout, text and original imagery on this site belong to Rush Cigars. Brand names, logos and product photography belong to their respective owners, including J.C. Newman Cigar Co., and are used to identify the products we sell. Nothing on this site grants you a licence to use any of those marks.

Limitation of liability

To the fullest extent permitted by law, Rush Cigars is not liable for indirect or consequential loss arising from the use of this site or the products bought through it. Nothing in these terms limits liability that cannot lawfully be limited, including under consumer protection legislation.

Governing law

These terms are governed by the laws of Canada and of the province in which Rush Cigars operates, and any dispute is subject to the jurisdiction of the courts there.

Changes to these terms

We may revise these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.
